Annual Reports from 2002 to date are available on this web site. Alternatively, you may request a copy or copies of the Annual Report in writing, via e-mail or by visiting the Office of the Contractor-General and making a request in person.

Does the Contractor-General award public sector contracts?

Answer:

No. The Contractor-General does not award any public sector contracts. Only agencies may award contracts. The Contractor-General is an independent Commission of Parliament responsible for monitoring and investigating the public sector procurement process, including the award of government contracts, licences and permits to ensure that this process is fair, transparent, and equitable.

At what point does the Contractor-General become involved in the procurement Process?

Answer:

The Contractor-General monitors and investigates public sector contracts, licences and permits. At the pre-contract stage inspectors from the Office of the Contractor-General, on behalf of this Commission, may provide guidance and/or advice to ministries, agencies and departments in preparation of contract documents and other best procurement practices. They also review published Invitations to Tender to ensure that all requisite information is contained therein.

If the Contractor-General requests information from an agency about any of the contracts that the agency has awarded, does this information have to be provided?

Answer:

Yes. The Contractor-General Act of 1983 endows the Contractor-General with certain rights and powers. Among these is access to all books, records, documents, stores or other property belonging to the Government.

Can the Contractor-General impose sanctions on public sector entities for non-compliance with established procurement procedures?

Answer:
|
The Contractor-General does not have the authority to impose sanctions for non-compliance with guidelines. He investigates issues which are related to non- compliance and reports them in the annual Contractor-General Report or, if necessary, submits a special report to Parliament on the matter.

Is the Contractor-General obliged to provide a copy of his investigation report to the complainant (s) who brought the matter to his attention or to the attention of the OC-G?

Answer:
|
No, he is not. Section 20 (1) mandates the Contractor-General to inform the principal officer of the Public Body concerned, as well as the Minister with portfolio responsibility therefore. In addition, according to Section 20 (2), the Contractor-General, if the Report reflects adversely upon any person, as far as is practicable, should inform that person of the substance of the report.
